It was Friday
Its written in T31 clutch upgrades section but its got 43000kms and the dual mass flywheel has turned blue from excessive heat. The flywheel is only 7mm thick and can't deal with the heat.
 No faults were found so I have to pay.
They still can't tell me why.

Its a very common problem and obviously a flaw with Navaras, Patrols X trails and basically any Nissan, Subaru and others with a dual mass flywheel.
I am upgrading to solid flywheel and heavy duty clutch which I should sort out today.

Given that we have 2 members having problems with the same dealership with a track record for strange behaviour it might be worthwhile for the people involved to contact the actual brains (or a least the money pit of the operation) because I'm sure he hasn't got to own as many dealerships as he has by constantly shafting the customer, especially considering his advertising used to focus on how often he said yes!

Hi Guys,

According to the laws of Fair Trading, all goods and services have a statutory warranty.

As a minimum, all retailers, services providers and manufacturers must ensure that:

    * their goods and services are suitable for the purpose for which they are sold
    * products are not faulty
    * they perform services to an appropriate standard
    * all samples match the products they sell
    * they honour warranties
    * they make spare parts available for a reasonable time.

I believe Nissan Australian is violating our rights as a consumer by selling faulty a product and not honouring the statutory warranty.

I have been in touch with the Nissan Australia since February 2009 and written many letters requesting them to correct this problem. I have taken the car to the dealer more than 8 times during this period.

Since February 2009 Nissan has tried many remedies with absolute no success. Now they have run out of ideas, so they are retrying failed remedies again hoping it might work this time around.

I believe the only way to get something done about this matter is to go public with this issue. I am now considering contacting the channel 7 “Today-Tonight” & channel 9 “A Current Affair”. If anyone is interested, please feel free to join me.

Hi Guys,

Please keep this thread on the topic of the faults reported in the first post.

Any dealership and warranty specific complaints and ideas of raising a complaint with fair trading and others are either to be posted in the "dealership feedback" or "Warranty claims and services" topics which we have in the Servicing section of the forum.

There are far too many xtrail owners who were unfairly treated by this particular dealership, so it's a good idea to highlight this in one of the above threads being monitored by Nissan Australia, rather than having bits and pieces of information scattered here and there.

Dave, I take the statement about the availability of a service bulletin regarding this issue back!

I just checked and wanted to get more information about such a bulletin only to be told there wasn't one issued (as yet) by Nissan Australia to any of the dealers. emoticon

There is no service bulletin about the CVT premature failure either!

 So I have expressed my concern to Nissan this morning, that I do not want to be charged another "diagnostic fee" on Thursday because of the obvious reasons. I will fight to recoup any monies lost after the fault has been identified and solved I think.

Do you think that is fair? Does the issue of a service bulletin mean that they`ve found the fault and know the remedy? Also Jalal, you mentioned earlier about the oil separator being a cause....is this a proven fault or has it just been 1 person`s experience? Should I mention this to the dealer on thursday?

Dave,

I didn't say Nissan Australia is not aware of it. What I said is that dealers have not been made aware of the fault and the possible cause of this problem. When you go in next time, you might want to mention the oil separator issue to them and ask them to speak to Nissan head-office about it.

You can also send a PM to the member who experienced this exact issue and ask him for an update.

P.S. I wonder if the Renault Koleos is experiencing the same issues, as it has exactly the same engine.

Hi Trainman78,

Nissan has no fix for this problem and they have similar cases in NSW, VIC & SA. What I believe is Nissan will drag this till the warranty ends and then charge an arm and a leg to fix this.

Basically as the EGR valve gets contaminated, your engine gets sluggish and idle sound gets louder. You lose bottom end torque and you have to rev it a lot to get the car moving. As this happens slowly you will not notice it. However when you replace the EGR valve, you will notice an immediate improvement of performance.

When I took the car in February 09 they said the engine had too much oil and reduced the oil level.

Then when I took it back again in September 09 they replaced the air filter and the EGR valve.

After that when I took it back in Mid October 09 they said it was the oil level again.

Then when I took it in the First week of November they told me it is the residue oil in the Air intake and they cleaned it and put another new air filter, and told me to come back in a month.

I am now sick of going to the dealer every month. I am seriously considering alternative action.

Thank you for the details cheena. It is absolutely absurd that we are treated in this way. I cannot believe I am starting to work out a bail out plan to get rid of this car ASAP because of this. I cannot keep paying these alleged "diagnostic fees" for the rest of my time with this car, and I cannot keep putting up with the inconvenience of going back to the dealer. I have never been treated this way with any other of my brand new cars in the past (Hyundai, Ford, Proton and VW) and I have never experienced a car company trying to get out of their warranty obligations as mych as Nissan have.
It`s interesting, after my talk with Ray Hadley on 2gb the other day, a mechanic rang up and told everyone that Nissan are the hardest company to get warranty claims out of. So it`s no only me thinking this.

You may think this only happens with Nissan, but not so.
I had an XR6 Falcon which was using so much oil that it did not get to the next 10,000km service before the oil light came on after about 7,000km.
I went through 3 "we will top up the oil level and see how much it uses" before after 20,000km they finally decided to pull the engine apart under warranty to find that the 2nd oil ring was MISSING in #2 cylinder.
Granted they also replaced the bigend bearings which were scored after being starved of oil but I got plenty of disbeliefs before finally pushing my point with Ford Australia who finally agreed that they had ONE similar problem and wanted the car for a week to check.

I think it is a fact of life these days with companies chasing dollars for investor returns that they will try anything they can to get out of warranty repairs, especially if you have short-changed them money by having your car serviced at an independant mechanic.
