Nissan would do anything to get out of paying for a fix.
Apparently nobody can drive a manual as I am sure they would tell you that's why it failed.
Seems that you are reading the same book that I did mate, hopefully it's a different ending on your last page.

I don't even have a manual... I threw my fate to the winds and opted for the late 2011 version IV of the CVT, hoping that the known problems were sorted out.
As the bloke said straight after jumping out a window...So far, so good.
For the clutch/dual weight flywheel issues: then everything posted here and elsewhere is evidence that there may be an inherent problem of design or execution.
Perhaps that could sway the balance should 'the weight of evidence' be measured in a Warranty claim taken to the next level.
In the unlikely (Edit: perhaps with due reference to previous posts, that word should be replaced with 'likely' ) circumstance that Nissan choose to go into denial, then the overweening consumer laws in Australia would see them left legless and with huge loss of face which would cost them dearly in Brand Faith.
To me, as an impartial observer, the dual mass flywheel seems to have a major issue in the given instance - mostly as I've never had a clutch fail ever. One was a bit doughey at 250,000 Km but it was a Nissan 280ZX and I don't know how the previous owners treated it
How can it wear out?
It must be a warranty repair.
Possibly a recall matter if others also recognise that they have suffered this failure and put some weight behind the complaint.

Yeah very long story but as expected they refused the warranty claim. We are now trying to get a good will claim. Should find out tomorrow.
I have already contacted department of fair trading to see where I stand if they refuse the good will claim.

Although it may be in some senses regarded as an improper use of influence, none of our elected representatives seem to suffer from this problem, so may I suggest that when you next pursue your warranty claim, that you casually mention that a couple of thousand X-Trail members and even more casual browsers are eagerly awaiting the result of your particular outcome.
Each of those thousands has access to the Internet.
Multiply that number by their friends and then again by those friends then by their friends...
Perhaps Karma (for a Business) does work on such a scale?

That doesn't work, I tried all that.
Talking to the dealer is a waste of time as Todd now knows, talking to Nissan Australia I found is just as bad.
Fair Trading were helpful but when it came to the crunch, it was basically my word against theirs.
My problem was that I couldn't rely on any Clutch specialist to put anything in writing or show up at a hearing, despite of what they told me face to face about Nissan clutches and the DM flywheel and why mine failed.
Todd, start writing everything down and keeping documentation for Fair Trading, dates, time paperwork from Nissan and log all discussions. Get copies of paperwork from the dealer for your records.
Sounding like an all too familiar process that gives me the !@#$ just writing about it.

It's not Nissan only that will fight it, any other car manufacturer will resist anything to do with a clutch claim and will always blame it on the way the car has been used.
I have never seen to date Nissan settle any clutch claim.

It's seems pretty simple to me. There is no excess wear of the clutch or flywheel. No burn marks suggesting the clutch has been ridden. Neither the clutch nor flywheel is warped. All measurements are within specs (according to advice from the dealer - they have advised Nissan the same).
The only thing Nissan are using to argue is that there is rust on the centre of the flywheel.
Other than that they are simply saying there is no evidence of a manufacturing fault. So basically every possible thing you can look at suggests the clutch has been used properly. Something has caused some rust and something has caused they internals of the flywheel to fail. If nothing suggests misuse of the clutch how could the failure be anything but manufacturer fault?
Jalal, the same dealer my car is at replaced a Navara clutch under warranty at 30,000km due to a failure with the DMF.

So Nissan have basically told me to get stuffed. The dealer and the mechanics were all on my side and actually told nissan they believe is was a manufacturing fault. None of that matters to Nissan it seems.
The dealer quoted me a smidge over $4k and I got a quote elsewhere of $3,100. So I told the dealer I would be picking it up in pieces and going elsewhere. They have since come back and told me they can do it with after market parts for $2,900. Hopefully pick it up monday arvo.
Oh and I have every intention of following this up further with the department of fair trading. How Nissan in Melbourne can be so arrogant as to assume they know more than mechanics here in Sydney looking at the parts in person is beyond me.
