Not sure where this idea of a 'Ban' came from but about 6 months after the ACMA introduced the 12.5kHz 80ch plan, it was always designed to be backward compatible with the old 40ch. Why would you make something backward compatible if you were banning them?
Anyway, from what I understand of the CB 'licence' conditions, all NEW radios must comply with the 80ch 12.5kHz step schema and good luck selling a 40ch. But if you have a 40ch they are not banned or illegal, and 'most' work OK with the new 80ch units. What we are seeing (or hearing for a more precise description) is the 80ch units sound 'tinny' & 'thin' to a 40ch unit because they are transmitting at 12.5kHz to a radio receiving at 25kHz width.
I moved all my 40ch CB's when they were still working out the schema and only kept programable units so no matter what they did all I had to do was write a new clone file.
FYI, the other 'big' changes were ch 1-8 & 31-38 (41-48, 71-78) are now dedicated duplex repeater channels and are NOT to be used in simplex mode and ch22&23 (&61,62,63) are dedicated telemetry channels and you should not be able to transmit voice on them, they should be locked out/disabled on any new voice radio.
