When I purchased my Nav, I was enquiring about warranty with genuine accessories and how on the Xy the bonet protector was wearing through the top of the grill.
He told me that any damage caused by genuine accessories would be replaced regardless of what damage they caused.
I think you'll find that any rubbing at all with the tailgate bumper should be fixed by Nissan, providing that they identify that the towbar is the cause.

Yeah Tony, but what they will replace, the towbar or the parts that it is now damaging (which is the tailgate and the bumper) and what with? another towbar with the same problem??

Unless Nissan identify the exact cause of this rubbing and fin a way to modify the fitment of the towbar, this problem will not go away.

That's interesting news and I would be interested to see how Nissan can get around the patent ownership of the towbars from local manufacturers unless they're planning to simply buy them out and re-brand them as Nissan. I also note the aim of this exercise is to reduce lead-times, but there is no mention at all of trying to improve the quality of the towbars and their fitting process, which is the main concern for Nissan owners!

Take the problem in house instead of a secondary supplier, smart way to make the problem go away, me thinks, But I could be way to cynical on the way Nissan handles a problem with a non OEM part.
I could be wrong and Its possible that they just want to maintain strict quality guidelines.

Well I took my car to the dealer today.
They had my car for 4 hours and have not fixed it.
There is a bulletin from Nissan which the dealer would not share with me, that requires them to remover the bumper and cut out a section and then replace this did not fix the issue.
The service consultant even agreed that it did not fix it and has taken photos and sent in a report to Nissan.
So still no fix and now have to deal with customer service and have Nissan accept that the tow bar is the issue and not dealer fitment.

Thanks mate, share that on their Facebook page under the towbar problem discussion. I told Nissan right from the start that the towbar is the cause of this problem, not the bumper.

have now had my third conversation with the nissan australia customer dis-service team.
They want more pics from my dealer, so have to take my car back to them.
i'm gonna send an invoice for my time to the dealer and nissan australia.
My service guy has told me he can replace my bumper to fix the rubbing but doesn't want to do it until the problem is fixed, i agree with him here.
Nissan Aust has known about this issue for a while now and i can see it on every T31 with a Nissan tow kit that i see on the road, and i'm on the road 9hrs a day as a sales rep...
This is my second issue with an exy (its a mighty fine car) but i am getting sick of the poor workmanship that this brand and model is exhibiting, and i find it hard to recommend it to my friends/colleagues and customers. emoticon
My best advice is for everyone that has this issue is to get a customer reference number and report it on Nissans Xtrail facebook page (as per jalal's comment) as a seperate comment also if you see another exy in your state with the problem tell the driver about it and tell them to contact Nissan Australia about it.
The more noise the better for us all.

Some of us had a look at this problem on the recent NSW/QLD trip.

The suggestion I had was to look at the boot catch on the bumper.
I think (atleast on the one I inspected) that the catch was too far towards the boot and probably needed to be adjusted out a little.
My feeling is that over time, constant closing is slowly pushing it towards to boot to a point where the tailgate then starts rubbing on the bumper.

We checked this by also seeing that the boot was recessed slightly from the sides of the rear panels.
I did not take pics but if Scot or John could post some pics of what we saw then it might help others to visualise it.
