What I found was that speed started to increase going downhill, cancelling cruise resulted in less speed increase. The software uograde was done last year and did seem to help in speed holding on level and uphill but not downhill. Flicking the CVT into manual will give plenty of engine braking, I generally do that prior to using brakes.

Drooped the car off at the dealer today to have the sat nav unit replaced and asked if there was a software update for the Series 3/4 T31 xtrails to fix cruise control problems. The service manager confirmed that there is indeed a software update available for the 2.5LT T31 xtrails and it takes about an hour to update the ECU. I asked them to have this update done.

False alarm. The service manager called Nissan Australia and they have confirmed that ALL Series 3 and Series 4 X-TRAILs already have the latest ECU software version and the cruise control should be working within 5km/hour difference which is within the allowable tolerance.
They have also confirmed that the excess speed I was getting on the run downhill is normal behavior of the CVT which can only slow the car so much using the gearing ratio, so am glad to hear its normal.

Eddie, your 2008 T31 needs to have a software update applied to it to fix a known cruise control problem, so your dealer should have access to the Nissan technical bulletin explaining what needs to be done. The software update takes an hour to do.

Thanks Jalaski. I only wish I read this before picking it up. I asked how he went with the bulletins and surprisingly, he couldn't find any info on it. I may now have to wait until we reach NSW in a couple of weeks and try another dealer, I guess the 877kms of Hume Hwy will be a good a place as any to test it out.
Needless to say, disappointed in my service dept. (But pleased to report they finally fixed the fuel sensor issue after the second attempt))!! Something to smile about.
